1. Agreement to Terms

By accessing or using AUTOTARGY ("Service", "Platform", "we", "us", or "our") at autotargy.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

AUTOTARGY provides a fully automated, AI-powered car listing analysis service that helps users evaluate used car advertisements from third-party websites. All analyses are performed entirely by artificial intelligence algorithms without human involvement. Our Service includes:

• AI Analysis: Automated analysis of car listings using artificial intelligence to identify potential risks, issues, and red flags
• Price Estimation: AI-generated price assessments based on publicly available market information
• Risk Assessment: Algorithmic evaluation of potential concerns based on listing content
• Image Analysis: AI-powered visual inspection of photos provided in listings
• Translation Services: AI-assisted translation of listing content

3. AI-Generated Content Disclaimer

All analyses, assessments, price estimates, risk evaluations, and recommendations provided by AUTOTARGY are generated entirely by artificial intelligence algorithms.

3.1 Limitations of AI Analysis

• AI analysis is based solely on information visible in the original listing (text, images, stated specifications)
• AI cannot detect hidden mechanical issues, undisclosed damage, odometer tampering, or other fraud not evident from listing content
• AI may misinterpret, overlook, or incorrectly assess information
• AI price estimates are approximations based on general market patterns and may not reflect actual market value
• Image analysis may produce false positives (identifying damage that doesn't exist) or false negatives (missing actual damage)
• AI cannot verify the accuracy, truthfulness, or completeness of information provided by sellers

3.2 No Guarantee of Accuracy

We make NO GUARANTEE regarding the accuracy, completeness, reliability, or usefulness of any AI-generated content. The Service is provided on an "as is" and "as available" basis. You acknowledge that:

• AI-generated analyses may contain errors, omissions, or inaccuracies
• Price estimates may differ significantly from actual market values
• Risk assessments may fail to identify actual problems or may flag non-existent issues
• You should NEVER rely solely on our AI analysis when making purchasing decisions

4. Third-Party Listings and Content

AUTOTARGY analyzes car listings from third-party websites (such as mobile.de, AutoScout24, Kleinanzeigen, OLX, Autovit, Otomoto, and others). We have no control over, and assume no responsibility for:

• The accuracy, truthfulness, or completeness of third-party listings
• False, misleading, or fraudulent advertisements
• Scams, fraud, or deceptive practices by sellers
• Omissions of material information by sellers
• Incorrect vehicle specifications, mileage, or condition descriptions
• Misrepresented photos or stolen images
• The existence, condition, or availability of any advertised vehicle
• The identity, legitimacy, or reliability of sellers
• Changes to listings after our analysis was performed

5. User Responsibilities

By using our Service, you acknowledge and agree that:

5.1 Due Diligence

• You are solely responsible for conducting your own due diligence before purchasing any vehicle
• You will obtain a professional physical inspection by a qualified mechanic before any purchase
• You will obtain an official vehicle history report (VIN check) from a reputable provider
• You will verify all information independently before making any purchasing decision
• You will meet sellers in safe, public locations and follow safe buying practices

5.2 Understanding of Limitations

• You understand that AUTOTARGY is an informational tool only, not a substitute for professional advice
• You understand that AI analysis has inherent limitations and may be incorrect
• You will not rely solely on our analysis for any purchasing decision
• You accept full responsibility for any vehicle purchases you make

5.3 Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You will provide accurate information during registration
• You will not share your account with others or create multiple accounts
• You will not use the Service for any illegal or unauthorized purpose
• You will not attempt to circumvent, disable, or interfere with the Service's security features

6. Credit System and Payments

6.1 Credit Purchases

• Credits are required to perform car analyses on our platform
• Credits are purchased through our secure payment processor
• All prices are displayed in the applicable currency at checkout
• Credits have no cash value and cannot be transferred to other users
• We reserve the right to change credit pricing at any time

6.2 Refund Policy

6.3 Unused Credits

• Purchased credits remain valid for 12 months from purchase date
• Expired credits cannot be refunded or restored
• We will send a reminder email 30 days before credits expire

7. Limitation of Liability

• Financial losses resulting from vehicle purchases made based on our analysis
• Vehicle defects, damage, or problems not identified by our AI analysis
• Scams, fraud, or deceptive practices by third-party sellers
• Incorrect, incomplete, or misleading information in third-party listings
• Mechanical failures, accidents, or safety issues with purchased vehicles
• Price differences between our estimates and actual market values
• Loss of profits, business, or opportunity arising from use of our Service
• Any damages arising from your reliance on AI-generated content
• Costs of repairs, legal fees, or other expenses related to vehicle purchases

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or EUR 100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Analysis results will be accurate, complete, or reliable
• Any errors in the Service will be corrected
• The Service is free from viruses or other harmful components

9. Indemnification

You agree to defend, indemnify, and hold harmless AUTOTARGY and its officers, directors, employees, agents, suppliers, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any vehicle purchases you make based on our analysis
• Any disputes with vehicle sellers
• Your content or data submitted to the Service

10. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are and will remain the exclusive property of AUTOTARGY. The Service is protected by copyright, trademark, and other laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems (bots, scrapers) to access the Service
• Resell or commercially exploit the Service or its content

11. Prohibited Uses

You agree not to use the Service:

• For any unlawful purpose or in violation of any laws
• To harass, abuse, or harm others

12. Termination

Upon termination, your right to use the Service will immediately cease. You may still request a refund for any purchases made within the last 14 days in accordance with our refund policy.
